The TXI Midlothian Cement plant in Texas is one of about 100 U.S. cement plants. About 10 mostly older plants may close to avoid the cost of compliance with the new rules.

Cement plants represent the third-largest source of mercury air emissions in the United States. The others:
* Coal fired power plants: 51%
* Industrial/Commercial/Institutional Boilers/Process Heaters: 15%
* Cement plants: 7%
